The Hotel Association of Canada (HAC) has saved hoteliers millions of dollars by successfully challenging a SOCAN Tariff on Pay Per View in hotel bedrooms; and millions more as a go forward.

Upon application for the Tariff, the HAC immediately filed its opposition with the Copyright Board of Canada citing that Pay Per View as proposed in Tariff 23 is provided by a third party service and does not fall under the ownership or control of the hotel.

This is a pass through service – the hotel is simply the host, stated HAC President Tony Pollard in Ottawa hearings on June 13. Pay Per View service providers own all the rights to the movies and the equipment, they control price, they control the in-room advertising pieces and they pay a commission from gross revenues.

OnCommand Corporation, LodgeNet Entertainment and GalaVu Entertainment Network, the three Pay Per View service providers in Canada, have now stepped up the plate and taken responsibility for Tariff 23. These three service providers have now negotiated their own tariff rates with SOCAN, saving the originally targeted hoteliers millions of dollars.
